1. Definitions

In these Terms and Conditions:

  • "Service" refers to the residential care services provided by dawnpesa
  • "Resident" means the individual receiving care services
  • "Family" or "Family Member" means the legal guardian, power of attorney holder, or designated representative of the Resident
  • "We," "Us," "Our" refers to dawnpesa
  • "Agreement" means the service contract entered into between dawnpesa and the Resident or their Family
  • "Facility" refers to the residential care home located at 55/8 Chaiyaphum Road, Nakhon Ratchasima 30000, Thailand

2. Acceptance of Terms

By engaging our services, visiting our facility, or using our website, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our services or website.

Residents must be at least 18 years of age or have a legal guardian authorized to enter into this Agreement on their behalf.

3. Service Description

dawnpesa provides three levels of residential care services:

3.1 Attentive Daily Support

Includes personal care assistance with grooming, dressing, room organization, and meal support. Weekly preference documentation and monthly care plan reviews.

3.2 Arts & Connection Program

Provides access to creative activities including paper folding workshops, memoir writing, miniature garden building, music sessions, and inter-generational programs.

3.3 Whole-Life Residential Care

Comprehensive residential living including private room, three daily meals, housekeeping, laundry, all personal care support, all activities, and 24-hour staffing.

Detailed service descriptions, inclusions, and limitations are provided in individual service agreements. dawnpesa is a non-medical facility and does not provide medical treatment or nursing care.

4. Enrollment and Admission

4.1 Assessment

All prospective residents undergo an initial assessment to determine if our services are appropriate for their needs. We reserve the right to decline admission if we determine we cannot adequately meet an individual's care requirements.

4.2 Required Documentation

Before admission, residents or their families must provide:

  • Completed application and health history forms
  • Emergency contact information
  • Medical records and current medications list
  • Proof of identity and legal documentation if applicable
  • Signed service agreement

4.3 Trial Period

The first 30 days of service constitute a trial period during which either party may terminate the Agreement with 7 days' notice if the arrangement is not working satisfactorily.

5. Payment Terms

5.1 Service Fees

Monthly service fees are:

  • Attentive Daily Support: ฿5,600 per month
  • Arts & Connection Program: ฿15,200 per month
  • Whole-Life Residential Care: ฿42,000 per month

5.2 Payment Schedule

Fees are due on the first day of each month. Payment can be made via bank transfer or other agreed methods. Late payments may incur a fee of 2% per month on outstanding balances.

5.3 Fee Adjustments

We reserve the right to adjust service fees with 60 days' written notice. Families will be informed of any changes in advance.

5.4 Additional Services

Services not included in the base fee (such as special dietary requests, personal shopping, or transportation for personal errands) may incur additional charges as agreed upon in writing.

6. Resident Responsibilities

Residents and their families agree to:

  • Provide accurate and complete information about health status and care needs
  • Notify staff promptly of changes in health or medication
  • Treat staff and other residents with respect and courtesy
  • Follow facility guidelines for safety and community living
  • Arrange for medical care through external healthcare providers as needed
  • Maintain appropriate personal property insurance
  • Pay fees on time according to the agreed schedule

7. Our Responsibilities

dawnpesa agrees to:

  • Provide services as described in the service agreement
  • Maintain a safe, clean, and comfortable living environment
  • Respect resident privacy and dignity
  • Document and honor individual preferences
  • Provide regular updates to families as specified in service agreements
  • Maintain appropriate staffing levels
  • Respond promptly to concerns or requests

8. Limitation of Services

dawnpesa is a non-medical residential care facility. We do not provide:

  • Medical diagnosis or treatment
  • Nursing care or medication administration (except as permitted by Thai law for non-medical care facilities)
  • Mental health counseling or psychiatric services
  • Rehabilitation therapy or specialized medical interventions

Residents requiring medical care must arrange this through external healthcare providers. We will assist in coordinating transportation for medical appointments but are not responsible for providing medical services.

9. Termination of Services

9.1 Voluntary Termination by Resident

Residents or their families may terminate services with 30 days' written notice. Payment is required for the full notice period.

9.2 Termination by dawnpesa

We may terminate services with 30 days' notice if:

  • Resident's care needs exceed our capability to provide appropriate support
  • Resident's behavior poses a safety risk to themselves or others
  • Payment obligations are not met after reasonable attempts to resolve
  • There is a serious violation of facility guidelines or this Agreement

9.3 Immediate Termination

We reserve the right to terminate services immediately without notice in cases of violence, serious threats to safety, or severe violations of community guidelines.

9.4 Effects of Termination

Upon termination, all outstanding fees must be paid. Personal belongings must be removed from the facility within 7 days. We will provide assistance in coordinating alternative care arrangements when possible.

10. Liability and Disclaimers

10.1 Service "As Is"

Our services are provided on an "as is" basis. While we strive to deliver high-quality care, we cannot make specific outcome guarantees.

10.2 Limitation of Liability

dawnpesa's liability is limited to the amount paid for services in the three months prior to any claim. We are not liable for indirect, incidental, or consequential damages.

10.3 Personal Property

We are not responsible for loss or damage to residents' personal property. Residents are advised to maintain appropriate insurance for valuable items.

10.4 Medical Emergencies

In medical emergencies, we will contact emergency services and the resident's designated emergency contacts. We are not liable for outcomes of medical emergencies or hospital care.

11. Dispute Resolution

11.1 Informal Resolution

We encourage residents and families to bring concerns directly to our staff. Most issues can be resolved through open communication.

11.2 Formal Complaints

If informal resolution is unsuccessful, formal complaints can be submitted in writing to management. We will respond within 14 days.

11.3 Governing Law

These Terms and Conditions are governed by the laws of Thailand. Any disputes will be subject to the jurisdiction of the courts of Nakhon Ratchasima Province.

11.4 Mediation

Both parties agree to attempt mediation before pursuing legal action, except in cases requiring immediate injunctive relief.

12. Privacy and Confidentiality

We are committed to protecting resident privacy. Personal and health information is handled in accordance with our Privacy Policy and applicable Thai data protection laws.

13. Modifications to Terms

We may modify these Terms and Conditions with 60 days' written notice. Continued use of services after modifications take effect constitutes acceptance of the updated terms. If you do not agree to modifications, you may terminate services as described in Section 9.

14. Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms and Conditions, together with the individual service agreement and our Privacy Policy, constitute the entire agreement between dawnpesa and the resident or their family regarding our services.
